A court may not grant an injunction to prevent or stay a commission order of denial of previously existing access to a state highway unless an owner or lessee of real property that adjoins the part of the highway to which access is denied under the commission's order:
(1) brings the suit at which the injunction is sought; and
(2) has not released any claim for damages resulting from the denial of access or a condemnation suit has not been commenced to ascertain the damages.
