(1) A person may not take or permit the person's dog to take, while in violation of Subsection 23A-5-317(2):
(a) protected wildlife or protected wildlife parts;
(b) an occupied nest of protected wildlife; or
(c) an egg of protected wildlife.
(2) A person who violates Subsection (1) is subject to the penalty provided in Section 23A-5-301.
