(1) Terms defined in Sections 76-1-101.5 and 76-9-1201 apply to this section.
(2) An actor commits unlawful obstruction of watergates if the actor:
(a) rafts or floats logs, timber, or wood down any river or stream; and
(b) allows the logs, timber, or wood described in Subsection (2)(a) to accumulate at or obstruct the watergates owned by a person or irrigation company taking or diverting the water of the river or stream for irrigation or manufacturing purposes.
(3) A violation of Subsection (2) is subject to the penalty provisions in Section 73-2-27.
