If any person is guilty of any fraud by tampering with the jury wheel prior to drawing jurors that person is guilty of a felony and, upon conviction thereof, shall be fined not more than $5,000, or imprisoned in the penitentiary for not less than one nor more than five years, or both fined and imprisoned.
