22 CFR 35.20: Definitions.

(a) The definitions of “authority,” “authority head,” “claim,” “investigating official,” “knows or has reason to know,” “person,” “presiding officer,” “reviewing official,” “statement,” “material,” and “obligation” are the same as those found in 31 U.S.C. 3801. The authority head for the Department is the Under Secretary for Management. In addition, the investigating official is the Inspector General of the Department of State or designee, and the Assistant Legal Adviser for Buildings and Acquisitions is the reviewing official.

(b) Complaint means the administrative complaint served by the reviewing official on the defendant under § 35.40(c).

(c) Defendant means any person alleged in a complaint under § 35.40(a) to be liable for a civil penalty or assessment under § 35.10.
