KRS 109.260: City providing solid waste management services pending implementation

(1) No provision of this chapter shall preclude a city from providing solid waste

management services pending implementation of the approved solid waste

management plan submitted by a county or district pursuant to KRS 224.43 -340.

Any county or waste management district that includes the provision of solid waste

management services to a city in its approved solid waste management plan shall

provide the city with written notice at least one (1) year prior to the date it intends to

provide such service to the city.

(2) A city may be delegated the responsibility for providing solid waste management

services by a county where it is mutually advantageous to do so, and bot h the city

and county agree to the delegation of authority. Upon delegation of responsibility, a

city acting by and through its legislative body may plan, initiate, acquire, construct

and maintain solid waste management facilities and promulgate rules and

regulations with respect thereto in accordance with this chapter.

(3) Any solid waste management plan submitted by a county or district pursuant to

KRS 224.43-340, that includes any city that has made a financial commitment for a

solid waste management sys tem, shall include provisions for insuring sufficient

revenues to the city to retire the debt on said system in accordance with the financial

obligations incurred by the city.
