(1) (a) The Kentucky Department of Education shall establish an instructional
materials depository for the schools of the Commonwealth.
(b) The department may enter into contracts to designate an entity to serve as the
department's agent to carry out the responsibilities of the depository under
KRS 156.395 to 156.476.
(c) To leverage the purchasing power of the Comm onwealth's schools, the
depository shall negotiate prices on behalf of the department and all school
districts.
(2) (a) In accordance with KRS Chapter 45A, school districts and the department
shall use the depository in purchasing the instructional materia ls included in
the state-approved list established by the State Quality Curriculum Task Force
under KRS 156.395 to 156.476.
(b) Superintendents of school districts shall use the instructional materials
depository to report the school district's selection o f instructional materials to
the department, unless the school district purchases approved alternate
instructional materials under KRS 156.439.
(3) The depository shall make available to school districts and the public the necessary
information for assessi ng the instructional materials included in the state -approved
list. The information shall include but not be limited to:
(a) Each of the instructional materials included in the state -approved list, capable
of being organized by grade or grade band and content area;
(b) Summary results of the instructional materials evaluations conducted by the
task force and any factual error identified in the instructional materials;
(c) A list of the accompanying manuals, workbooks, and other ancillary items for
instructional materials included in the state-approved list; and
(d) A list of the school districts within the state that have adopted each of the
instructional materials, including for each school district:
1. The statewide assessment results in the associated content area; and
2. Identification of any interim or formative assessment utilized by the
district pursuant to KRS 158.6453(8).
