Notwithstanding any other provisions contained in this chapter, a certificate of need shall
not be required for an existing intermediate -care facility for individuals with an
intellectual disability (ICF/ID) to add beds which shall be dedicated to providing respite
services to individuals with an ICF/ID level of care for no more than thirty (30) days. The
establishment of ICF/ID respite beds shall be limited to three (3) beds per fifty (50)
ICF/ID beds in a facility and shall not be eligible for Medicaid certification. Beds
designated for respite services under this section shall comply with all applicable federal
and state licensure requirements for intermediate -care facilities for individuals with an
intellectual disability.
