KRS 224.40-320: Processing of permit applications -- Time frame to be established --

Burden of proof -- Requirement for specific findings.

(1) The cabinet shall establish by administrative regulation a time frame for the review

and issuance or denial of applicatio ns for a solid waste management facility permit

or modification.

(2) The applicant shall have the burden of establishing that the application complies

with all requirements of KRS Chapter 224 and the administrative regulations

adopted by the cabinet. The c abinet shall make specific findings with respect to the

compliance of the application with this chapter and the regulations of the cabinet.
