KRS 230.830: Operation and regulation of fantasy contests -- Duties of corporation --

  1. KRS Chapter 230

Restrictions -- Administrative regulations.

(1) The corporation shall promulgate administrative regulations in accordance with

KRS Chapter 13A to govern the operation of fantasy contests and enforce KRS

230.830 to 230.848, but the corporation shall not limit or restrict lawful fantasy

contests solely by labeling them as sports wagering, except the corporation may

classify a contest as sports wagering when warranted by its actual characteristics

and consistent with state and federal law.

(2) The corporation shall:

(a) Regulate the conduct of fantasy contest service providers;

(b) Promulgate administrative regulations to regulate fantasy contests no later

than one hundred eighty (180) days after July 15, 2026;

(c) Require a fantasy contest service provider to use geolocation technology to

verify that a fantasy contest participant is physically present in the

Commonwealth when submitting an entry unless otherwise authorized by the

corporation; and

(d) Exercise any other powers necessary to enforce the provisions of KRS

230.830 to 230.848.

(3) The corporation and fantasy contest service providers shall cooperate with

investigations conducted by law enforcement agencies, includin g but not limited to

providing and facilitating the provision of account level entry and participation

information.

(4) Any participant in a fantasy contest shall be at least eighteen (18) years old.

(5) A licensed fantasy contest service provider shall no t be forced to surrender or

terminate a license prior to the date of expiration of the license solely by virtue of a

change in the qualifications for licensure under KRS 230.830 to 230.848.
