  1. KRS Chapter 381

The court shall swear the witnesses, preside over the inquest and trial, decide all matters

of law, preserve order, and may adjourn from day to day until the jury has completed the

inquest. In case the jury first summoned fails to attend, or, after being s worn, fails to

agree and render their verdict, the court shall summon another jury, on a day to be named

in his mandate in writing. The court shall make out and return to the clerk's office from

which the writ issued, a complete record of the proceedings b efore him, together with the

original writ, the verdict, and assessment of the jury, certified by him. Either party shall

have the right of challenge to the jurors allowed in civil cases, and any deficiency in the

jury may be supplied by summoning others.
