- KRS Chapter 394
(1) An electronic will may be simultaneously executed, attested, and made self -proving
by acknowledgment of the testator and affidavits of witnesses.
(2) The acknowledgment and affidavits under subsection (1) of this section shall be:
(a) Made before a notary public authorized to administer oaths under the law of
the state in which execution occurs or, if fewer than two (2) attesting
witnesses are physically present in the same location as the testator at the time
of signing under KRS 394.706(1)(b), before a no tary public authorized under
KRS 423.455;
(b) Evidenced by the notary public's certificate under official seal affixed to or
logically associated with the electronic will; and
(c) In a form substantially similar to KRS 394.225(1) and (2).
(3) A signature p hysically or electronically affixed to an affidavit that is affixed to or
logically associated with an electronic will under KRS 394.700 to 394.715 is
deemed a signature of the electronic will under KRS 394.706(1).
