KRS 80.410: Resolution creating authority -- Form -- Effect -- Use in evidence.

  1. KRS Chapter 80

In any suit, action or proceeding involving the validity or enforcement of or relating to

any contract of an authority, the authority shall be conclusively deemed to have become

created as a public body corporate and politic upon proof of the adoption of the resolution

or resolutions of the governing body or bodies declaring the need for the authority as

required in KRS 80.320 to 80.610. Such resolution or resolutions shall be deemed

sufficient if it declares that there is such need for the authority and fi nds in substantially

the foregoing terms (no further detail being necessary) that the conditions enumerated in

KRS 80.380 exist in the city or county, as the case may be. A copy of the resolution or

resolutions duly certified by the clerk shall be admissible in evidence in any suit, action or

proceeding.
