A Local Law to amend the administrative code of the city of New York, in relation to the forfeiture of vehicles used for unlawful dumping in certain cases

Be it enacted by the Council as follows:

Section 1. Declaration of legislative findings and intent. Illegal dumping of refuse, construction debris, and other wastes, including hazardous wastes, on public and private property in the city has reached epidemic proportions, endangering human life and safety and thereby creating a public emergency. The present penalties have not been sufficient to deter this illegal and dangerous activity. Certain persons have treated the fines and penalties imposed for illegal dumping as a cost of doing business. This is especially the case with respect to hazardous waste because of the high cost of lawful disposal. It is therefor necessary in order to deter such activity to provide for the forfeiture of vehicles unlawfully used to dump hazardous waste and of vehicles used for other unlawful dumping where the owner has demonstrated flagrant disregard of the illegal dumping law by committing three or more violations of such law within an eighteen month period.

§ 3. This local law shall take effect ninety days after it shall have been enacted into law and shall apply only to violations committed after such effected date.
