Okla. Stat. tit. 37A, § 37A-6-123: Selling alcoholic beverages during unauthorized day or

hours – Penalties.

Any person selling or keeping a package store open to sell any

alcoholic beverage during any day or hours not authorized by the

Oklahoma Alcoholic Beverage Control Act, and any person selling or

permitting the sale of alcoholic beverages at a grocery store,

convenience store or drug store during any day or hours not

authorized by the Oklahoma Alcoholic Beverage Control Act shall be

guilty of a misdemeanor for a first violation, and upon conviction

shall be fined not more than Five Hundred Dollars ($500.00), or

imprisoned in the county jail for not more than one (1) year, or by

both such fine and imprisonment. Any person convicted of a second

or subsequent violation shall be guilty of a Class D1 felony

offense, and shall be fined not less than Two Thousand Five Hundred

Dollars ($2,500.00) nor more than Five Thousand Dollars ($5,000.00),

or imprisoned as provided for in subsections B through F of Section

20N of Title 21 of the Oklahoma Statutes, or by both such fine and

imprisonment. The ABLE Commission shall revoke the license of any

person convicted of a violation of this section.
