An association authorized to write accident, health, or hospitalization insurance may pay the reasonable costs of defending a contested claim on an accident, health, or hospitalization insurance certificate from the mortuary fund of the association if:
(1) the expenditure is approved by the commissioner; and
(2) the association has the reserves required by Subchapter I.
