Tex. Occupations Code § 2051.452: INVESTIGATION AND PRELIMINARY REPORT.

(a) If, after examining a possible violation, including facts relating to the violation, the secretary of state determines that a person has committed a violation of this chapter, the secretary shall issue a preliminary report stating:

(1) the facts on which the determination is based; and

(2) that an administrative penalty will be imposed, including the amount of the penalty.

(b) The secretary shall, not later than the 10th day after the date a preliminary report is issued under Subsection (a), send to the person who is the subject of the report:

(1) a copy of the report; and

(2) notice that the person may request a hearing under Section 2051.453.
