Tex. Occupations Code § 402.101: GENERAL POWERS AND DUTIES.

(a) The executive director shall administer and enforce this chapter.

(b) The department shall:

(1) evaluate the qualifications of applicants;

(2) examine applicants; and

(3) in connection with a hearing under this chapter, issue subpoenas, examine witnesses, and administer oaths under the laws of this state.
