A person may not use an automated dial announcing device to make for solicitation purposes a telephone call in which the device plays a recorded message when the connection is completed unless:
(1) the recorded message is shorter than 30 seconds; or
(2) the device has the technical capacity to:
(A) recognize a telephone answering device on the called person's line; and
(B) terminate the call within 30 seconds.
