KRS 156.439: District allocation of state instructional materials funds -- Use -- School

(1) The Kentucky Board of Education shall promulgate administrative regulations in

accordance with KRS Chapter 13A to establish the method for c alculating and

distributing a district's allocation of state instructional materials funds. The district's

allocation shall be used by schools to purchase:

(a) Instructional materials and programs from the state-approved list;

(b) Instructional materials a nd programs not on the state -approved list if

notification is submitted to the department that the material meets the

selection criteria of the task force in KRS 156.405(3)(a) or (b), the subject

specific criteria of the instructional materials reviewers p ursuant to KRS

156.407(4), and compliance with the required specifications;

(c) Instructional materials and programs, with an approved plan pursuant to

subsection (2) of this section;

(d) Instructional materials and programs for a subject not included in t he state-

approved list if the district demonstrates that the district already maintains

high quality instructional materials in the subjects included on the state -

approved list and has a need in a subject not included on the state -approved

list; or

(e) Any combination of the above.

(2) The district shall use the instructional materials depository established in KRS

156.412 to identify all purchases it makes with an instructional materials allocation

and shall keep on file a plan developed by each school, in accordance with

administrative regulations promulgated by the Kentucky Board of Education, for

providing the necessary instructional materials for all grades for reading and

writing, mathematics, science, and social studies. A school may carry forward to the

next school year any part of its instructional materials allocation which has been

distributed to the district.
