KRS 304.38-1955: Construction of provisions for services by licensed optometrist or

licensed ophthalmic dispenser to include same services from licensed

physician.

Any certificate, agreement, or contract issued in this state by a health maintenance

organization wh ich provides coverage for services which can be lawfully performed

within the statutory scope of practice of a duly -licensed optometrist or duly -licensed

ophthalmic dispenser shall be deemed to provide benefits for such services whether

performed by a duly -licensed physician or a duly -licensed optometrist or duly -licensed

ophthalmic dispenser, notwithstanding any provision contained in the certificate,

agreement, or contract.
