- Article - Local Government
(a) In this section, “civil penalty” means a civil fine or other monetary
penalty administratively imposed.
(b) Unless otherwise provided by statute, ordinance, or regulation, an
officer or unit of a county, municipality, bicounty agency, or board of license
commissioners authorized by law to impose a civil penalty up to a specific dollar
amount for violation of a statute, ordinance, or regulation shall consider the following
in setting the amount of the civil penalty:
(1) the severity of the violation;
(2) the good faith of the violator; and
(3) any history of prior violations.
