SDCL § 9-14-16: Elected officials not to hold other office--Exclusion--Alcoholic beverage license not disqualifying--License vote.

Except as otherwise provided in § 9-14-16.1, an elected municipal officer may not hold any other position with the municipality while in office. The term "position" does not include membership on any municipal board, commission, or committee, if the ordinance or resolution establishing the board, commission, or committee specifically includes the elected officer in the membership of the board.

An elected officer is not disqualified from holding office in any municipality as a result of holding, or being the spouse of an individual holding, any alcoholic beverage license, pursuant to chapter 35-4. An elected officer who is the holder of a license may vote on the issuance or transfer of any other alcoholic beverage license.
