- 225 ILCS 10/11 · Whenever the Department of Children and Family Services or the Department of Early Childhood is advised, or has reason to believe, that any person, group of persons or corporation is operating a child welfare agency or a child care facility without a license or permit, it shall make an investigation to ascertain the facts. If the Department is denied access, it shall request intervention of local, county or State law enforcement agencies to seek an appropriate court order or warrant to examine the premises. A person or entity preventing the Department of Children and Family Services or the Department of Early Childhood from carrying out its duties under this Section shall be guilty of a violation of this Act and shall be subject to such penalties related thereto. If the Department of Children and Family Services or the Department of Early Childhood finds that the child welfare agency or child care facility is being, or has been operated without a license or permit, it shall report the results of its investigation to the Attorney General, and to the appropriate State's Attorney for investigation and, if appropriate, prosecution.

- 225 ILCS 10/11.2 · Whenever the Department expressly finds that the continued operation of an early care and education provider, including such part day programs described in paragraph (1) of subsection (d-10) of Section 3 and unlicensed providers, jeopardizes the health, safety, morals, or welfare of children served by the provider, the Department shall issue an order of closure directing that the operation of the provider terminate immediately, and, if applicable, shall initiate revocation proceedings under Section 9 within ten working days. A provider closed under this Section may not operate during the pendency of any proceeding for the judicial review of the decision of the Department to issue an order of closure or to revoke or refuse to renew the license, except under court order.
